Accused 4’s court bid to have charges dropped in Meyiwa case resumes – SABC News

The High Court in Pretoria is on Monday morning expected to hear an application of one of the accused to have the charges against him dropped in the former Bafana Bafana captain Senzo Meyiwa’s murder trial.

Mthokoziseni Maphisa and four others are on trial for killing Meyiwa in October 2014.

Earlier this month, four of Maphisa’s co-accused opted not to proceed with the discharge application.

The court heard that Legal Aid South Africa would not pay for a lengthy postponement in order for defence counsels to prepare for the application to have charges dismissed.

While Adv Charles Mnisi informed the court he needed four weeks to adequately prepare for the application on behalf of Muzi Sibiya and Mthobisi Mncube, accused one and three in the matter, he also said that it would be difficult to prepare a detailed application without reimbursement.

Defence Counsel Sipho Ramosepele, who represents accused two Bangani Ntanzi, told the court they were advised that they do not have a strong case to proceed with the discharge application.

Only Maphisa will pursue the application.

Arguments on the matter are expected to be heard on Monday morning.
