Judgment has been reserved in the leave to appeal application in Nigerian televangelist Timothy Omotoso rape case sitting in the Gqeberha High Court.

This follows Judge Irma Schoeman’s decision earlier this year to acquit Omotoso and his co-accused on charges of rape and human trafficking.

The National Prosecuting Authority (NPA) has argued that whether or not their case will be successful in the Supreme Court, should not play a factor in Schoeman allowing them to take the matter up to a higher court.

Omotoso’s lawyer Peter Daubermann argued that there has to be a reasonable prospect of success in order for the applicants to be granted the appeal, and that the NPA failed to meet the jurisdictional requirements of Section 319.

NPA Spokesperson Luxolo Tyali says they are committed to bringing justice to the victims.

Tyali says, “As the NPA we remain committed that victims find justice. For that, we are willing to take the matter to the highest court. We believe the outcomes of the court has far too many implications on the criminal justice system. We believe crucial evidence was never considered.”
