MK argues Ramaphosa acted beyond his powers in Mchunu decision

Advocate Dali Mpofu has argued that President Cyril Ramaphosa went beyond his powers when he placed Police Minister Senzo Mchunu on a leave of absence.
Advocate Mpofu, who is representing the Umkhonto weSizwe party and leader Jacob Zuma, says that what Ramaphosa did was illegal.
Zuma and his party are back in the High Court in Pretoria, sitting in the palace of justice, to challenge Ramaphosa’s July decisions.
Advocate Mpofu presents his argument: “We say, for present purposes, the most important difference is that while a suspension is an involuntary act imposed, or quote-unquote, placed on a person, leave of absence is, by definition, a voluntary step taken at the instance or initiative of the taker and invariably granted by the giver. That’s an elementary proposition.”
