Parliament to relook at it’s processes following Hlophe ruling – SABC News
Parliament says it will relook at its processes following the Western Cape High Court judgment that found MK Party parliamentary leader, Doctor John Hlophe, was not eligible to serve on the Judicial Services Commission.
Hlophe, who is the former Western Cape High Court Judge President, was found guilty of gross misconduct by the JSC and subsequently impeached by Parliament in 2024.

Despite that, he was designated to the JSC, as nominated by his party and voted for by the National Assembly.
The court had ruled that the National Assembly’s decision to designate Dr Hlophe from among its members to the JSC was unconstitutional, invalid and therefore reviewed and set aside.
Parliament’s spokesperson Moloto Mothapo says parliament will ensure that in future all designations to constitutional bodies comply with the constitutional principles outlined in the court ruling.
“As this judgment bears implications for Parliament’s eternal arrangements, procedures, and processes relating to the designation of representatives to the JSC and other constitutional bodies, Parliament will take all necessary steps to ensure alignment with the Court’s findings. This includes instituting the appropriate processes to ensure that future designations comply with the constitutional principles outlined in the judgment.”
