Suspect accused in Tracy Brown murder appears in Gqeberha court

The 33-year-old suspect accused of killing State Prosecutor Tracy Brown, made his first appearance in the Gqeberha Magistrate’s Court on Monday.

Simthembela Xungu faces charges of murder, conspiracy to commit murder, unlawful possession of two firearms and possession of ammunition.

According to the Directorate for Priority Crime Investigation (Hawks) the 42-year-old prosecutor was gunned down by four men on July 31, 2025 in Gqeberha.

“The attack was carried out in front of her home, in the presence of her partner,” said Hawks spokesperson, Lieutenant Colonel Avele Fumba.

Fumba said a multidisciplinary investigation team worked closely with police teams to trace the suspects.

Intelligence gathered by the investigative team revealed that Xungu fled to Johannesburg.

“While investigators were pursuing leads in Johannesburg, critical information was received indicating that the suspect was travelling back towards Gqeberha.

“Acting with precision, the team strategically coordinated roadblock in the early hours of August 21. The suspect’s vehicle was intercepted, and he was successfully apprehended,” Fumba said.

The matter has been postponed to September 3 for legal representation and a formal bail application. The suspect remains in custody.
