No evidence linking Maphisa to Meyiwa murder: Defence – SABC News
Arguments in the application to have charges against one of the accused in the former Bafana Bafana captain Senzo Meyiwa murder trial dismissed are expected to continue on Tuesday morning at the High Court in Pretoria.
Accused four, Mthokoziseni Maphisa is the only one applying to have his charges dropped after his co-accused abandoned the process.
Defence counsel Zithulele Nxumalo told the court that key state witness Constable Sizwe Zungu, who placed all accused at a hostel in Vosloorus the evening of the murder, has provided hearsay evidence.
Nxumalo says there is no evidence linking Maphisa to the conspiracy to murder Meyiwa.
He says, “That evidence does not reveal any prior agreement amongst the accused, including accused number four to kill the deceased. There is absolutely no evidence, my Lord, that accused number four was present at the scene of crime, where the violence was being perpetrated, either circumstantial or direct.”
