Father insists the sex was consensual, sentenced for raping his biological daughter

A 66-year-old North West man has been sentenced to 20 years of direct imprisonment by the Bafokeng Regional Court for raping his biological daughter, a case described by police as a shocking betrayal of parental responsibility.

The man was found guilty of raping his daughter in November 2022 at Chaneng village near Phokeng. At the time, the victim was 18 years old.

According to North West provincial police spokesperson Brigadier Sabata Mokgwabone, the father threatened her with a knife before committing the heinous crime.

Despite pleading not guilty and insisting that the sexual act was consensual, his defence was rejected. The court relied on the victim’s testimony, backed by DNA evidence, which proved his guilt beyond doubt.

Mokgwabone said the outcome sends a strong warning to perpetrators of gender-based violence.

“This sentence demonstrates that the justice system will not tolerate such heinous crimes, particularly when committed by those who are meant to protect and nurture,” Mokgwabone said.

He added: “We commend the bravery of the victim in testifying against her father, and we salute the dedication of the investigating team and the prosecution for ensuring that justice was served.”

Authorities reaffirmed their commitment to tackling gender-based violence.

“This punishment should serve as a reminder to offenders that such crimes will not go unpunished,” Mokgwabone said.

In addition to the sentence, the court declared the man unfit to possess a firearm under the Firearms Control Act.

Meanwhile, acting provincial police commissioner, Major General Dintletse Molefe and North West Director of Public Prosecutions, Dr Rachel Makhari have welcomed the ruling, praising investigating officer Detective Sergeant Joyce Seake and prosecutor Advocate Zola Mpayipheli “for their diligent work”.
