Two boys aged 11, 13 in court for alleged rape of Grade 5 learner – SABC News

Two North West learners aged 11 and 13 are expected to appear at the Temba Magistrate’s Court tomorrow on a charge of rape.

Provincial police and education authorities have confirmed the incident.

It is alleged that a Grade 5 learner was raped by two male learners at Mmatsheko Primary School.

Education Department Spokesperson, Vuyo Mantshule, says the incident was witnessed by fellow learners at the school.

It was reported to the school’s management, social workers and the police.

The alleged sexual activity between a Grade 5 learner and two male learners occurred on the school premises after school hours. The incident was witnessed by other learners and subsequently reported to the school-based support team.

The school responded by notifying the social worker, contacting parents and guardians and initiating psychosocial support.

The learners involved admitted to the activity during an SGB meeting.

The girl learner was taken for medical examination.

Meanwhile, Provincial Police Spokesperson, Brigadier Sabata Makgwabone, says the suspects have been placed under the custody of their parents while investigations are ongoing.

“The South African Police Service confirms the case in question and that the matter is dealt with in terms of the provisions of the Child Justice Act of 2008. The minors aged 11 and 13 made their initial court appearance on the 19th of September 2025. The matter was postponed until Tuesday, 30th of September 2025. The minors are placed under the custody of their parents,” says Makgwabone.
