Nkabinde targeted by EFF and MK in Parliament perjury storm

The Economic Freedom Fighters (EFF) has opened and registered a criminal case of perjury against Cedrick Nkabinde after his testimony before Parliament on Thursday.

Nkabinde is accused of deliberately misleading the ad hoc committee probing allegations made by Lieutenant General Nhlanhla Mkhwanazi in July.

The MK Party has also accused him of giving contradictory evidence and has signalled its intention to lay its own charge of perjury.

The EFF said Nkabinde submitted false evidence under oath during the committee’s sitting on Thursday, November 13, 2025.

The party insists he misrepresented when he first received the contact details of Brown Mogotsi, a figure implicated in alleged corruption involving senior SAPS leadership and the Minister of Police.

According to the EFF, Nkabinde told the committee he only obtained Mogotsi’s number from the Minister around October or November 2024, even though evidence before the committee showed he had confirmed the number on September 30, 2024.

The party described Nkabinde’s conduct as a deliberate attempt to conceal politically sensitive information and to frustrate Parliament’s constitutional mandate.

EFF spokesperson Sinawo Thambo said the party regarded Nkabinde’s conduct as “a calculated and deliberate attempt to undermine Parliament’s authority, interfere with its constitutional mandate, and shield individuals implicated in wrongdoing.”

”Perjury is a criminal offence, and no individual, regardless of political connection or proximity to power, will be allowed to misuse parliamentary platforms to hide the truth.”

Thambo said the registered case should serve “as a clear warning to all who will appear before the Ad Hoc Committee that deception, distortion, and political manipulation will not be tolerated,”

“We will make an example with Mr Nkabinde, no one undermines an oath before Parliament and lives to tell the story without consequence,” he added.

He said the case against Nkabinde “sends a firm and uncompromising message that the EFF will act decisively against anyone who seeks to mislead Parliament, obstruct investigations, or protect corrupt networks through dishonesty.”

Thambo added that the EFF had received confirmation from SAPS that the matter had been officially registered at Cape Town Central police station under reference number CAS 736/11/2025.

He said the party regarded the registration as “a critical step in ensuring that deliberate dishonesty under oath is met with the full force of the law.”

“This is not a political performance; it is a determined effort to defend the integrity of Parliament and to confront the deep-seated rot within our justice and policing systems.

”Those who come before Parliament must understand that honesty is not optional; it is a constitutional and moral obligation.

The EFF will continue to expose corruption, challenge deceit, and hold all who betray the public trust fully accountable,” Thambo said.

He added that the party would closely monitor the investigation and any resulting prosecutions to “ensure that the truth prevails and justice is served.”

Meanwhile, the MK Party said Nkabinde’s evidence contained “glaring contradictions and fabrications.”

The party noted that in his affidavit, he claimed not to know Mogotsi before the Minister instructed him to set up a meeting in November 2024.

Yet in the same statement, he said Mkhwanazi had called him in September 2024 to ask if he knew Mogotsi, and that he confirmed he did.

MK Party spokesperson Nhlamulo Ndhlela said these inconsistencies “expose Mr Nkabinde as an unreliable witness who has lied under oath, thereby compromising the integrity of the Committee’s process and misleading Parliament.”

“These contradictory statements cannot coexist,” said Ndhlela.

He confirmed that the party would also lay a charge of perjury, saying the MK Party remained committed to “transparency, truth, and accountability” and urged the committee to treat the inconsistencies with the seriousness they deserved.
